Definitions:
“The Client” is a parent or legal guardian(s) of a learner (“the Learner”), or an organisation supporting a Learner. EBL Consultancy provides educational and/or behavioural service provision to support the Learner’s learning, behavioural and/or development needs.
Data collected and stored by EBL Consultancy:
In order for EBL Consultancy to provide a safe and professional service, we need to keep certain records about you (the Client) and/or the Leaner. We process the following types of data:
Your basic details and contact information e.g. your name, address, date of birth and next of kin;
Your financial details e.g. transaction details;
Biographical information such as your or education and work history;
Your Learner’s skills and learning needs, including the progress that is made by your Learner. This information relates to developmental areas such as their verbal, fine motor, gross motor, daily living, and social skills;
EBL Consultancy also record the following data which is classified as “special category”:
Health and social care data about you, which might include both your physical and mental health data;
In rare circumstances data about your race, ethnic origin, sexual orientation or religion.
This data is usually provided to us by you, your parent or guardian (if you are under 18), your legal representatives, or third parties involved in your care, for example school teachers, your Learner’s tutor(s), Speech and Language Therapists and Occupational Therapists.
Why is this Data Collected:
EBL Consultancy needs this data to enable us to provide high-quality care and support. The legitimate interests which allow EBL Consultancy to process your data include:
To manage our relationship with you;
To provide and manage services set our in a contract;
To keep our records up to date;
For internal evaluation purposes, to monitor how we are performing;
To exercise our rights, to defend ourselves from claims and to keep to laws and regulations that apply to us and the third parties EBL Consultancy work with;
To adhere to social security and social protection law (generally this would be in safeguarding instances).
How this data will be used:
EBL Consultancy will only use your personal information when the law allows. Most commonly, EBL Consultancy will use your personal information in the following circumstances:
In order to perform the contract that EBL Consultancy has entered into with you;
Where EBL Consultancy needs to comply with a legal obligation.
If you do not provide your data:
If you do not provide your and/or your Learner’s personal data when requested, EBL Consultancy may not be able to perform the contract that they have entered into with you.
Data sharing:
In order to provide high quality care and comply with the law, EBL Consultancy may lawfully share your personal data with third parties, including:
Other parts of the health and care system such as local hospitals, the GP, social workers, Integrated care boards, and other health and care professionals;
The Local Authority;
Your family or friends – with your or your legal guardians permission;
Data about your Learner’s skills and learning needs will be shared with your Learner’s tutors;
Other members of you or your Learner’s professional network such as tutors, school teachers, Speech and Language Therapists, Occupational Therapists).
We will always seek your prior written consent when sharing data relating to you or your Learner with third parties. The exception to this is if EBL Consultancy has a legal obligation to share information by law or court order with the police or other law enforcement agencies.
To provide you with our services EBL Consultancy may also share your data with third-party processors, e.g. for processing payments. Where we do so will ensure appropriate contractual safeguards are in place to keep your data secure.
If you do not wish your data to be shared with others involved in your care you may opt-out by contacting us using the contact information in this Privacy Notice (see the top of the page), however please note that in some instances we may still be required by law or regulatory bodies to share the information.
EBL Consultancy will not sell or share your data with other third parties, except in the following cases:

EBL Consultancy stores electronic data on a password protected computer which has up-to-date antivirus software.
EBL Consultancy may store paper documents with personal data. These will be stored in a lockable filing cabinet until they are scanned and shredded.
How long your data will be kept for:
EBL Consultancy will only retain personal information for as long as necessary to fulfil the purpose it has been collected for, including the purposes of satisfying any legal, accounting or reporting requirements. When data is no longer required to fulfil the purpose it has been collected for, it will be securely deleted or destroyed. You will be notified if your data is kept for longer than this period.

In order to protect your security, EBL Consultancy use the strongest available browser encryption and store all of our data on servers in secure facilities. All data is only accessible to our employees and subcontractors. Our employees and subcontractors are bound by strict confidentiality agreements and a breach of this agreement would result in the employee/subcontractor’s termination.
While EBL Consultancy take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The internet as a whole can be insecure at times and therefore EBL Consultancy are unable to guarantee the security of user data beyond what is reasonably practical.
